The terms governing your use of Chhabi Electric Mobility's website, apps, chargers and services.

1. Acceptance of Terms

1.1 These Terms of Service ("Terms") constitute a legally binding agreement between you and Chhabi Electric Mobility Pvt. Ltd. ("Chhabi", "Company", "we", "us", or "our") governing your access to and use of the website located at chhabi-mobility.com, the Chhabi Watt mobile and web applications, and the purchase or use of Chhabi's electric vehicle charging hardware and related services (collectively, the "Services").

1.2 By accessing the website, placing an order, or using the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

1.3 These Terms apply to all persons who interact with the Services, including:

  • B2C Users — individuals who purchase or use a home AC charger (Chargiq Core or Chargiq Edge), or who use a public or commercial Chargion charging station.
  • B2B Customers — companies, fleet operators, and dealers purchasing Products, Annual Maintenance Contracts, or consultancy Services.
  • White-Label Partners — Charge Point Operators (CPOs), original equipment manufacturers (OEMs), and charging networks reselling Chhabi hardware or software under their own brand (see Clause 6).

2. Definitions

3. Products & Services Covered

3.1 Chhabi offers the following categories of Products and Services:

  • Everyday Charging (AC) — Chargiq Core and Chargiq Edge, available in 7.2/11/22 kW configurations, for homes, workplaces, and residential societies.
  • Destination Charging (DC) — Chargion Prime (30 kW), Chargion Max (60/90/120 kW), and Chargion Ultra (180/240 kW), for highways, malls, fleet hubs, and bus depots.
  • Services — direct sales, Annual Maintenance Contracts (AMC), consultancy (including site survey, commissioning, and preventive maintenance), and white-labelling.

3.2 Product specifications, images, and availability are subject to change without prior notice. Chhabi undertakes reasonable efforts to ensure that information published on the website is accurate but does not warrant that it is error-free at all times.

4. Orders, Pricing & Payment

4.1 Prices displayed on the website or in quotations are exclusive of GST and other applicable taxes unless expressly stated otherwise, and remain subject to change until an order is confirmed.

4.2 An order is confirmed only upon Chhabi's written acknowledgment, including an order confirmation email or a signed purchase order in the case of B2B transactions.

4.3 Payment terms for B2B orders, including advance payments, milestone-based payments, and credit terms, shall be set out in the applicable quotation or purchase order.

4.4 Chhabi reserves the right to cancel or refuse any order, including on account of pricing errors, unavailability of stock, or suspected fraudulent activity.

4.5 Online payments are processed through a third-party payment gateway. Chhabi does not store your full payment card details; such information is processed and secured by the payment gateway in accordance with applicable law.

5. Warranty, AMC & Returns

5.1 The following Products carry the following standard warranty periods from the date of purchase:

5.2 The warranty set out above does not cover damage or malfunction caused by misuse, unauthorized repair or modification, improper installation not performed or approved by Chhabi, accident, or normal wear and tear.

5.3 To raise a warranty claim, you must contact Chhabi using the details in Clause 11 and provide proof of purchase together with a description of the defect. Chhabi shall, at its discretion, repair, replace, or issue a credit in respect of the affected Product.

5.4 Nothing in this Clause 5 limits any right or remedy available to you under the Consumer Protection Act, 2019, or any other applicable law that cannot be excluded by contract.

5.5 Annual Maintenance Contracts, where purchased, are governed by the specific AMC agreement executed with the customer, which shall take precedence over this Clause 5 in respect of AMC-covered matters.

6. White-Label Partner Terms

6.1 Where Chhabi supplies hardware, dashboards, or software for use under a Partner's own brand, this Clause 6 applies in addition to the rest of these Terms:

  • This general Terms of Service does not replace the individual white-label or reseller agreement executed with each Partner, which governs the commercial and legal relationship between Chhabi and that Partner.
  • End users interacting with a charger operated under a Partner's brand are customers of that Partner for billing and first-line support purposes; Chhabi remains responsible for the underlying performance of its hardware in accordance with the applicable Partner agreement.
  • Each Partner is responsible for ensuring that its own end-user-facing terms and privacy notices are legally adequate for the markets and customers it serves.

7. User Accounts, App & Charging Station Use

7.1 You are responsible for maintaining the confidentiality of your account credentials, including your application login, RFID card, and QR access, and for all activity conducted under your account.

7.2 Charging stations must be used solely for their intended purpose. You shall not tamper with, damage, or attempt to bypass the security or authentication systems of any Chhabi charger.

7.3 Chhabi may suspend or terminate your access to the Services in the event of a breach of these Terms, fraudulent use, or non-payment.

7.4 Session data, including energy consumed, session duration, and cost, shall be made available to you through the application or dashboard for the purpose of billing transparency.

8. Intellectual Property

8.1 All trademarks, including "Chhabi", "Chhabi Watt", "Chargiq", and "Chargion", and all associated logos, together with all website content, software, and documentation, are the property of Chhabi or its licensors. No right, title, or interest in such intellectual property is transferred to you.

8.2 You shall not copy, modify, reverse-engineer, or redistribute any Chhabi intellectual property without Chhabi's prior written consent.

8.3 In respect of white-label Partners, the use of Chhabi trademarks, software, and branding is governed by the specific terms of the applicable white-label agreement and not by this Clause 8.

9. Limitation of Liability & Disclaimers

This section sets out the limits on our liability for products and services supplied by Chhabi:

9.1 To the maximum extent permitted by applicable law, Chhabi's aggregate liability arising out of or in connection with your use of the Products or Services shall not exceed the amount paid by you for the specific Product or Service giving rise to the claim.

9.2 Chhabi shall not be liable for any indirect, incidental, or consequential loss or damage, including loss of profits or loss of use, arising out of or in connection with the Products or Services.

9.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019, or liability for death, personal injury, or gross negligence.

9.4 Chhabi's Products are electrical equipment. Installation shall be carried out only by authorized personnel and in accordance with Chhabi's guidelines. Chhabi shall not be liable for any damage arising from installation that is not performed or approved by Chhabi.

10. Governing Law & Dispute Resolution

10.1 These Terms are governed by the laws of India.

10.2 Subject to any consumer protection rights that cannot be waived by contract, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Jalgaon, Maharashtra.

10.3 In respect of disputes arising under B2B or white-label agreements, the parties shall first attempt to resolve the dispute through good-faith negotiation. If the dispute remains unresolved within 30 days, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by mutual agreement of the parties, seated in Jalgaon, Maharashtra, with proceedings conducted in the English language.

11. Changes to Terms & Contact

11.1 Chhabi may amend these Terms from time to time. The "Last Updated" date at the top of this page reflects the date of the most recent revision. Continued use of the website or Services following any amendment constitutes acceptance of the amended Terms.
